For the authorization of the temporary occupation of space for the location of ventorrillos and hawker stalls to be held in different locations and dates in the municipality of Puerto del Rosario, with the opening dates and place to be determined in the respective call, will be attended to the determinations of the bases indicated below:
- Purpose of the award: The ventorrillo/ ventorrillos or similar stalls will be awarded, being ventorrillo understood as any temporary or dismountable installation, as well as any vehicle-tent-caravan, etc. that on the occasion of festivals or public shows is installed temporarily for the specific use of itinerant sale of beverages and/or food, or any other type of products or services.
- Applications: The procedure is initiated when the interested party submits the “Application for Authorization to install a ventorrillo” by electronic registration, or any of the means provided by law, within the opening period that will be published on the website of the City Council, and must be accompanied by the documentation listed in the following section.
3. Documentation to accompany the application: In advance it is anticipated that, in the event that the application for initiation does not meet the requirements indicated by or if the documentation is incomplete, the interested party will be required to, within 5 days, correct the lack of documentation or accompany the mandatory documents, indicating that, in case of not attending it, it will be considered abandoned its request, archiving without further proceedings with the effects provided in Article 21 of the law 39/2015; having to accompany the application for authorization of installation of ventorrillo the following documentation:
- GENERAL DOCUMENTATION:
- DNI of the holder/applicant.
- Photo of the ventorrillo from the outside.
- Proof of registered office.
- Proof of payment of Social Security contributions for self-employed workers.
- In relation to the registration of the workers, it will be included in one of the epigraphs that are related to the activity of itinerant sales or similar, among which the epigraphs are indicated as an example:
- 4: Other attractions, retail trade and catering services typical of fairs and festivals, outside permanent establishment.
- 1: Retail sale of foodstuffs, beverages and tobacco in stalls and flea markets.
- 1: Retail trade outside a permanent commercial establishment of food products, including beverages and ice cream.
- In relation to the registration of the workers, it will be included in one of the epigraphs that are related to the activity of itinerant sales or similar, among which the epigraphs are indicated as an example:
- Food handling license.
- Proof of payment of civil liability insurance.
- Liability insurance policy with insured risk of street vending stall and an insured premium of €600,000.00.
- Technical Data Sheet of the “Ventorrillo” showing its classification according to its use (street vending, store vehicle or similar) or, if applicable, a certificate signed by a competent technician guaranteeing the structural adequacy and adequacy of the technical conditions in compliance with the purpose for which it is intended.
- Bulletin and/or Certificate in force of the electrical installations and, if applicable, of the gas installation.
- Certificate of installation of the means of Fire Protection in accordance with the provisions of the RIPCI, as well as the maintenance certificate established for each means.
- In the application form, in addition to the contact information of the owner/applicant, the dimensions of the ventorrillo must be stated, as well as the responsible declaration attached in ANNEX I of this instruction.
In the case of Associations, collectives, clubs or other non-profit entities, a photocopy of the CIF, founding deed registered in the corresponding Registry of Associations, ID of the representative who must be a member of the board of directors, as well as a sworn statement signed by the representative and the secretary or treasurer with a copy of the national ID of the declarants, stating that the profits obtained will be used for the entity’s own purposes.
In any case, documentation must be provided to prove that the applicant is registered as: self-employed or entrepreneur (Current Social Security Situation Report, GENERICO as of an updated date); Certificate of status in the AEAT economic activities census as of an updated date in the headings and activities corresponding to street vending or similar (within the sectorial area).Example: 982-4; 663-1; 478-1 in the epigraphs and activities corresponding to street vending or similar; CNAE 478.1; Certificate of being up to date with the tax obligations of the AEAT as of an updated date and Certificate of being up to date with the social security obligations as of an updated date.
The person who signs the application will be the person who, in case of obtaining authorization, will appear as the holder of the application, and all the required documents must be in the name of the same person.
